Subject: Updating OSHA Standards Based on National Consensus Standards

Purpose: The purpose of this action is to remove references to consensus standards that have requirements that duplicate, or are comparable to, other OSHA rules, and remove a reference to the American Welding Society Standard A3.0 - 1969 in OSHA's general industry welding standards. The updated references affect the following standards: 1910.6 Incorporated by reference; 1910.68 Manlifts; 1910.94 Ventilation; 1910.103 Hydrogen; 1910.107 Spray finishing using flammable and combustible materials; 1910.110 Storage and handling of liquid petroleum gases; 1910.111 Storage and handling of anhydrous ammonia; 1910.144 Safety color code for marking physical hazards; 1910.243 Guarding of portable power tools; 1910.253 Oxygen-fuel gas welding and cutting; and 1910.261 Pulp, paper, and paper-board mills.

A.      Background

  1. On March 14, 2008, OSHA published a direct final rule updating OSHA references to a number of national consensus standards, plus an identical proposed rule. This rulemaking is a continuation of OSHA's ongoing effort to update references to consensus and industry standards used throughout its rules. In this direct final rule, OSHA removed several references to consensus standards that have requirements that duplicate, or are comparable, to other OSHA rules.
     
  2. On June 25, 2008, the Commissioner of Labor and Industry adopted, through incorporation by reference under COMAR 09.12.31 Maryland Occupational Safety and Health Act - Incorporated by Reference of Federal Standards, amendments relating to Updating OSHA Standards Based on National Consensus Standards, 29 CFR 1910, published in 72 FR 71061- 71070 (December 14, 2007). This action which was proposed for adoption in 35:10 Md. R. 989 (May 9, 2008) has been adopted as proposed.

B.       Action

  1. MOSH compliance personnel shall enforce the amendments relating to Updating OSHA Standards Based on National Consensus Standards, 29 CFR Part 1910.
     
  2. MOSH Compliance and Consultation Supervisors shall ensure that training sessions are conducted on the contents of this notice.
