Subject: Updating OSHA Standards Based on National Consensus Standards; Personal Protective Equipment

Purpose: The purpose of this action is to revise the Personal Protective Equipment (PPE) sections of the general industry standards regarding requirements for eye- face-protective device, head protection, and foot protection.
 
Scope: This standard is MOSH-wide

A.  Background

  1. On February 8, 2011, the Commissioner of Labor and Industry adopted, under COMAR 09.12.31 Maryland Occupational Safety and Health Act - Incorporation by Reference of Federal Standards, amendments relating to the Clarification of Employer Duty To Provide Personal Protective Equipment and Train Each Employee, 29 CFR Parts 1910 and 1926, excluding parts 1915, 1917, and 1918, published in 73 FR 75568 - 75589 (December 12, 2008), as amended. This action, which is proposed for adoption in 37:26 Md. R. 1790 (December 17, 2010), has been adopted as proposed. Effective Date: March 7, 2011.
     
  2. This action was considered by the Maryland Occupational Safety and Health Advisory Board pursuant to a meeting held on April 7, 2010, notice of which was given in accordance with State Government Article § 10-506(c), Annotated Code of Maryland.

B.  Action

  1. MOSH compliance personnel shall enforce the revisions relating to the PPE Standard - Direct Final Rule, 29 CFR Part 1910 and 1926.
     
  2. MOSH Compliance and Consultation Supervisors shall ensure that training sessions are conducted on the contents of this notice.
