#19-022 In the matter of jockey, Charlie Amaro, subject of Stewards Ruling #19-021, dated January 27, 2019. On February 1, 2019, Charlie Amaro appeared before the Stewards at Charlestown Race Track in cooperation with the Maryland Board of Stewards upon the request of the Counselor at Charlestown Race Track, for consideration of reinstatement to good standing. The Counselor along with the HCP coordinator for the MTHA provided the results of drug tests and an evaluation indicating that Mr. Amaro is presently drug free and not a detriment to the best interests of racing. He recommended that he be reinstated to good standing and permitted to return to work subject to the following stipulation:

That at the Stewards discretion he submit to drug testing by the HCP Coordinator, the Stewards, or their designated representative. [COMAR 09.10.03.05.]

In light of the above, the Stewards hereby order that Charlie Amaro be reinstated to good standing subject to the above-stated stipulations.

#19-023 Trainer, Wayne Potts, is fined two hundred and fifty dollars ($250.00) for failure to report the proper gender of his entry “Selectman” that ran on January 27, 2019.
(Note: As per COMAR 09.10.04.05, failure to pay a fine within 48 hours from being notified may result in a suspension of license.)

#19-024 On January 31, 2019, the Stewards received notice from the Truesdail Laboratories, Inc. that urine sample #27499, dated January 19, 2019, contained the drug dextrorphan which is not on the approved list of Controlled Therapeutic Substances for the Maryland Racing Commission. The Stewards established that urine sample #27499 was taken from the horse “Miss Altamira”, owned by Roberto Sanson and trained by Josue Irazarry, following the running of the eighth race at Laurel Park on January 19, 2019. The Stewards notified Mr. Irizarry that: (1) the presence of dextrorphan in the system of “Miss Altamira” at the time the horse ran constituted a violation under COMAR 09.10.03.04 Drug Prohibition - Horses; (2) He had the right to have the split sample tested by an independent laboratory prior to the Stewards conducting a hearing in this matter; and (3) He had the right to be represented by counsel at the hearing.

Mr. Irizarry did not exercise his right to the split sample testing. (COMAR 09.10.03.09 H 1, 2, & 3)

The Stewards held a hearing via telephone on February 2, 2019. Mr. Irizarry waived his right to legal counsel.

Based upon the evidence before them, the Stewards find the following:

  1. Miss Altamira” did carry dextrorphan in its system when it finished first in the eighth race at Laurel Park on January19, 2019, a violation under COMAR 09.10.03.04, Section C;
  2. Josue Irizarry, as trainer, was the absolute insurer of, and responsible for, the condition of “Miss Altamira” at the time the horse ran (Sections D & F) ;
  3. A horse found to have carried a drug in its body during a race may be disqualified and the purse monies earned by that horse redistributed and
  4. An individual found to have violated these Regulations may be subject to a fine issued by the Stewards of up to $2,500 and a suspension of any license issued by the Maryland Racing Commission of up to 360 days. COMAR 09.10.03.02, Section A.

Based upon the evidence presented at the hearing and a precedent set by the Maryland Racing Commission: Trainer Josue Irizarry will not be sanctioned.

A separate hearing was held concerning the Multiple Medication Violation Point System.

Trainer Josue Irizarry will be assigned one (1) Multiple Medication Violation Point.

for not having the colors for “Incorporate”, entered to run in the third race at Laurel Park on February 15, 2019, after receiving a warning on (02/02/2019 ) for the same offense.

#19-033 In the eighth race, at Laurel Park on February 21, 2019, horse #11 “Sharon’s Thunder”, ridden by apprentice jockey, Adrian Flores, was disqualified
from second position and placed eighth. After turning for home #11 “Sharon’s Thunder” came over and bothered #9 “Tizadoozi” ridden by jockey Grant Whitacre, forcing him to take up sharply to avoid clipping heels.
[Violation under COMAR 09.10.01.50, A (1) b & e, which states in pertinent parts: “A horse may not: (b) Cross or weave in front of another horse without sufficient clearance, or (e) Impede another horse.]

#19-034 Apprentice jockey Adrian Flores is suspended three (3) Maryland racing days
, February 24, 28 and March 1, 2019, for riding the horse “Sharon’s Thunder” in a careless manner in the eighth race at Laurel Park on February 21, 2019, thereby causing the disqualification of “Sharon’s Thunder” from second to eighth position.

#19-035 In the matter of the sixth race at Laurel Park on February 18, 2019, regarding the Offical result.

On February 21, 2019 trainer, Jose Corrales filed an appeal with the Maryland Racing Commission. The appeal contests the Stewards' decision to make the result official without any change to the order of finish.

As a result of that appeal, the sixth race on February 18, 2019, is hereby declared in dispute and the following ordered to remain in effect until the dispute has been settled by the Maryland Racing Commission:

  1. Both “Whirlin Curlin” and “Chargin Storm” shall be subject to all penalties attached to the winner of the race [COMAR 09.10.04.15, A(1)]; and
  2. The purse monies affected by the dispute are to be held by the Horsemen's Bookkeeper.
