Davis Martinez Public Employee Safety and Health Act 2025

The Davis Martinez Public Employee Safety and Health Act, passed by the Maryland General Assembly in 2025, amended the Maryland Occupational Safety and Health (MOSH) Act in several ways to enhance protections for public sector employees by

1. Reducing workplace hazards,
2. Strengthening reporting and recording requirements, and
3. Increasing accountability for workplace safety in places of public employment throughout Maryland.

Workplace Violence Prevention Standard

Maryland Occupational Safety and Health (MOSH) is developing a workplace violence prevention standard as part of its implementation of the Davis Martinez Public Employee Safety and Health Act.

Stakeholder Meetings

MOSH hosted a series of in-person and virtual public meetings to engage stakeholders and gather information. Written comments were accepted through July 17, 2026.

Regulation Update

A draft Workplace Violence Prevention Standard has been developed and will be presented and discussed at the MOSH Advisory Board Meeting on September 25, 2026.

Public Sector Safety and Health Annual Report

Pursuant to Labor and Employment Article, §5-206(f), Annotated Code of Maryland, the Commissioner of Labor and Industry must publish an annual written report online regarding safety and health in public bodies. The Safety and Health in Public Bodies Annual Report summarizes MOSH’s public sector work and findings, new regulations adopted, and trending public sector safety and health issues.
