Purpose: This Instruction adopts the OSHA National Emphasis Program – Nursing and Residential Care Facilities. The Instruction describes policies and procedures for targeting and enforcement efforts to reduce occupational illness and injury in nursing and residential care facilities in North American Industrial Classification System (NAICS) codes 623110, 623210 and 623311 (formerly Standard Industrial Classification (SIC) codes 8051-Skilled Nursing Care Facilities, 8052-Intermediate Care Facilities, and 8059-Nursing and Residential Care Facilities, Not Elsewhere Classified).
 
Scope: This Instruction applies MOSH-wide.

Summary

The Instruction describes policies and procedures for targeting and enforcement efforts to reduce occupational illness and injury in nursing and residential care facilities. This document also includes Outreach and training activities to enhance effectiveness of this effort. The specific hazards being addressed include ergonomic stressors in patient lifting, bloodborne pathogens, tuberculosis, workplace violence, and slips, trips and falls.

Action

  1. MOSH compliance and consultation personnel shall ensure utilize OSHA Directive CPL 03-00-016 while preparing for and performing on site inspections and visits in nursing and residential care facilities.
  2. Supervisors shall ensure that this instruction is reviewed with all compliance officers and consultation staff.
  3. Wherever the OSHA Instruction references job titles and offices, the equivalent MOSH job title or office shall apply.
  4. Wherever the OSHA Instruction references medical records or privacy, COMAR 09.12.22 Personally Identifiable Employee Medical Information, shall be utilized instead. Do not use Appendix B for medical records release, contact the MOSH medical records officer.
  5. Note this a three year long MOSH Instruction and at least 3 facilities will be inspected per year.
  6. The IMIS identifier code to be used in item 25d on the OSHA-1 will be "NURSING."
