January 1, 2020 - Laurel Park
#20-001 Trainer, Adam Ingram is fined Twenty-five dollars ($25.00)
for not having the colors for “Wild River”, entered to run in the ninth race at Laurel Park on December 29, 2019, after receiving a warning on (10/03/2019 ) for the same offense.
THIS IS A VIOLATION OF: [COMAR 09.10.01.09] which states in part……
“It shall be the sole responsibility of the trainer to see that his or her owner’s colors are in the jockey’s quarters to be used for his or her respective entries, failure to do so, the trainer will be subject to fine”.
(Note: As per COMAR 09.10.04.05, failure to pay a fine within 48 hours from being notified may result in a suspension of license.)

#20-004 In the third race, at Laurel Park on January 4, 2020, horse #3 “Annimated Moon”, ridden by Jockey Horacio Karamanos was disqualified from first position and placed second.
Through the stretch, #3 “Annimated Moon”, came out on #6 “Souper Highvoltage” ridden by Trevor McCarthy, brushing with that horse a couple of times and continued to herd said horse out, beating that horse in a tight finish.
[Violation under COMAR 09.10.01.50, A (1) a & d, which states in pertinent parts: “A horse may not: (a) Carry a horse in or out, or (d) Intimidate another horse.]

#20-006 In the seventh race, at Laurel Park on January 11, 2020, horse #5 “Court Sky”, ridden by Jockey Alex Cintron was disqualified from second position and placed fifth.
After turning for home, #5 “Court Sky”, while lugging in, came over into the path of #6 “Occhi d’Oro” ridden by Taylor Hole, causing that horse to check sharply and get bounced around with the horses inside of him.
[Violation under COMAR 09.10.01.50, A (1) b & d, which states in pertinent parts: “A horse may not: (a) Cross or weave in front of another horse without sufficient clearance; or (d) Intimidate another horse.]

#20-017 In the matter of the fourth race at Laurel Park on January 18, 2020, regarding the Offical result.

On January 20, 2020 owner/ trainer, John Robb filed an appeal with the Maryland Racing Commission. The appeal contests the Stewards' decision to make the result official without any change to the order of finish.

As a result of that appeal, the fourth race on January 18, 2020, is hereby declared in dispute and the following ordered to remain in effect until the dispute has been settled by the Maryland Racing Commission:

  1. Both “Artful Splatter” and “Anna’s Bandit” shall be subject to all penalties attached to the winner
    of the race [COMAR 09.10.04.15, A(1)]; and
  2. The purse monies affected by the dispute are to be held by the Horsemen's Bookkeeper.

#20-018 In the matter of owner Herman Braude’s protest of a claim involving the horse “Hydra” and trainer John Robb’s possible violation of a COMAR 09.10.01.07L(2)(a) “preventing an owner from claiming a horse”
.
The horse “Hydra” was in the eighth race at Laurel Park on January 4, 2020. The Claims Official received a valid claim from owner, Gene Gould, Jr. for the horse “Hydra”, while the Claims Official did not receive a claim from Mr. Braude.

On January 20, 2020 a Stewards hearing was held concerning these matters. In attendance were owner Herman Braude, his secretary Taryn Dodd, trainer John Robb and MRC Investigators Joe Poag and Dennis O’Neil. After hearing all testimony the Stewards find that the claim of “Hydra” by owner Gene Gould, Jr. was a valid claim. At the hearing, Mr. Braude acknowledged that he had not submitted a claim in accordance with COMAR 09.10.01.07D, which states in pertinent part:

D. A valid claim shall:
(1) Be in writing on a form provided by the association;
(2) Be in the name of a person qualified to claim a horse;
(3) Be signed by the person, or the agent of the person, in whose name the claim is made;
(4) Contain the name of the horse to be claimed in a manner sufficient to avoid confusion with the name of another horse in the race;
(5) Name the trainer who will assume control and responsibility of the horse to be claimed;
(6) Be for the amount printed in the program as the claiming price of the horse;
(7) Be enclosed in a sealed envelope, provided by the association, which shall contain no identifying marks on its outside other than the number of the race in which the claimed horse is to participate;
(8) Be deposited in a lock box of the claims clerk at least 10 minutes before the post time for the race in which the claimed horse is to participate; and

Post time for race #8 was 3:50 p.m. As Mr. Braude failed to submit a valid claim by 3:40p.m., he failed to make a valid claim.
As to Mr. Robb preventing Mr. Braude from claiming “Hydra”, the testimony was that Mr. Robb made no effort to prevent Mr. Braude from making a valid claim. The testimony was that Mr. Robb attempted to advise Mr. Braude that he was not putting a claim in for Mr. Braude, but there was no evidence that Mr. Robb made an effort to prevent Mr. Braude to claim “Hydra”. Therefore, the Stewards find that Mr. Robb did not prevent Mr. Braude from claiming a horse.
