Mr. Brian Cavey called the Council meeting to order at 9:00 a.m. at Associated Builders and Contractors, Inc., Metropolitan Washington Chapter, 6901 Muirkirk Meadows Drive, Suite F, Beltsville, Maryland 20705 and welcomed all Council members, staff and guests in attendance. Mr. Jason Roberts, Director of Education, for the Metropolitan Washington Chapter, thanked the Council for again chosing their training facility to hold the Council meeting.

I. The first order of business was the approval of the minutes of the January 8, 2019 Maryland Apprenticeship and Training Council meeting. The minutes of the January 8, 2019 Council meeting were approved as submitted.
Acting Secretary James Rzepkowski contratulated Mr. Cavey upon his appointment as Chairman of the Maryland Apprenticeship and Training Council by Governor Hogan. He also welcomed Mr. Neil Wilford, newly appointed Employer Reprsentative to the Council. He added that recruitment was still underway for a new Public Representative. He thanked Mr. Ronald Leonard of the U.S. Department of Labor for his attendance at the Council meeting and thanked him for his part in assisting Maryland in all of the good things being done by apprenticeship in Maryland. He announced the Governor Hogan had appointed former DLLR Secretary Kelly M. Schulz to be the new Secretary of the Maryland Department of Commerce. He added that Governor Hogan had asked he and Commerce Secretary Schulz work very closely together to promote both econmic and workforce development in Maryland.
II. DIRECTOR’S REPORT:
A.Mr. MacLarion also congratulated Mr. Cavey on has appointment as chairman and Mr. Wilford on his appointment to the Council.
B. Council members were provided with an update of the status of the Apprenticeship and Training Fund. Mr. MacLarion reported that the balance as of February 28, 2019 after all obligations was $737,502.35. Contributions coming into the fund were $23,342.94 for the month of January 2019 and $17,129.66 for the month of February 2019.
C. Mr. MacLarion informed the Council that he was still working with the U.S. Department to configure the RAPIDS reporting system for apprenticeship for allowing apprentices to be registered in more than one state which is currently not allowable. He stated that he had been on a call with Mr. Leonard that this should be ready in a couple of months.
D. Mr. MacLarion reminded those in attendance of the $1,000 tax crdit for new Registered Apprentices. He added that $500,000 per year is allocated for tax credits meaning 500 tax credits that are available on a first come, first served basis.
E. Council members were reminded of the Maryland State Department of Education’s Apprenticeship Maryland Conference scheduled for April 10, 2019. Mr. MacLarion noted that Council members and sponsors had been sent a conference packet by email and added that printed copies were available at the Council meeting. He went on to note that in addition to Youth Apprenticeship, there was also an increase in activity for School-to-Registered Apprenticeship as well.
III. NEW BUSINESS:
A. NEW PROGRAMS:
1. Eaton Corporation (Ginamarie Best) – Occupations of CNC Operator, Welding Technician and Industrial Maintenance Technician. Related instruction to be provided by the Community College of Baltimore County and the Maryland Manufacturing Exension Partnership, Inc. Request for registration of an Affirmative Action Plan with Apprentice Selection Procedures and goals and timetables for minority and female apprentices.
Ms. Best presented this request for registration of Standards of Apprenticeship to the Council and introduced Mr. Paul Oh who was in attendance at the meeting representing Eaton Corporation.
A motion to approve this request for registration of Standards of Apprenticeship was made by Mr. Smarte, seconded by Mr. Bromley and unanimously approved.
Mr. Cluster made note of a difference between the nummber of of journeypersons shown on the Standards Report form and what was shown on the Workforce Analysis form
A motion to approve the Affirmative Action Plan with apprentice selection procedures and goals and timetables for minority and female apprentices as corrected was made by Mr Smarte, seconded by Mr. Bromley and unanimously approved
2. Howard Community College (Christopher D. MacLarion) – Occupation of Construction Project Manager. Related intruction to be provided by Howard Community College. Request for registration of an Affirmative Action Plan with apprentice selection procedures and goals and timetables for minority and female apprentices.
Mr. MacLarion presented this request for registration of Standards of Apprenticeship to the Council and introduced the representatives from Howard Community College who were in attendance at the Council meeting.
A motion to approve this request for registration of Standards of Apprenticeship was made by Mr. Smarte, seconded by Mr. Bromley and unanimously approved.
A motion to approve the Affirmative Action Plan with apprentice selection procedures and goals and timetables for minority and female apprentices was made by Mr. Shmelzer, seconded by Mr. Cluster and unanimously approved.
B. PROGRAM REVSIONS:
1. 1199 SEIU Training and Upgrading Fund (John F, Vontran) - Revision to add the occupation of Central Sterile Processing Technician. Related instruction to be provided by the Community College of Baltimore County Randallstown Center.
Mr. Vontran informed Council members that Central Sterile Processing Technician was a new competencey-based occupaion and provided them with a brief description of the occupation.
A motion to approve this revision was made by Mr. Shmelzer, seconded by Mr. Clinedinst and unanimously approved.
2. Baltimore Alliance for Careers in Healtcare (John F. Vontran) - Revision to add the occupation of Central Sterile Processing Technician. Related instruction to be provided by the Community College of Baltimore County Ranallstown Center.
A motion to approve this revision was made by Mr. Smarte, seconded by Mr. Bromley and unanimously approved.
3. Baltimore City Joint Apprenticeship Committee (John F. Vontran) - Request for reactivation of Tree Trimmer with updated schedule of on-the-job training work processes, related instruction curriculmm and apprentice wage progression schedule.
Mr. Vontran informed the Council that the occupation of Tree Trimmer had been approved March 3, 1976 but has never had a registered apprentice. Reactivation of the occupation was being requested for the Department of Recreation and Parks.
A motion to approve the reactivation of Tree Trimmer with updated schedule of on-the-job training work proceses, related instruaction curriculum and apprentice wage progression schedule was made by Mr. Shmelzer, seconded by Mr. Clinedinst and unanimously approved.
4. Heating and Air Conditioning Contractors of Maryland, Inc. (John F. Vontran) – Revision to the minimum qualifications for apprenticeship to permit registration of high school students in an approved School-to-Apprenticeshp Program.
A motion to approve this revision was made by Mr.Shmelzer, seconded by Mr. Smarte and unanimously approved.
5. I.E.C. Chesapeake, Inc. (John F. Vontran) – Revision to change the location of related instruction classes in Hagerstown, Maryland to 17301 Valley Mall Road in Hagerstown.
Employer Representative Grant Shmelzer recused himself from the consideration of this item of Council business.
A motion by Mr. Cluster and seconded by Mr. Bromley to approve this revision was approved with six (6) Council members in favor of the motion, none opposed and one (1) abstention.
6. I.E.C. Chesapeake, Inc. (John F. Vontran) – Request for revision to Section 12 – Apprentice Wages and Fringes of the Standards of Apprenticeship.
Employer Representative Grant Shmelzer recused himself from the consideration of this item of Council business.
A motion by Mr. Cluster and seconded by Mr. Clinedinst to approve this revision was approved with six (6) Council members in favor of the motion, none opposed and one (1) abstention.
7. Ironworkers Local No. 5 JATC (John F. Vontran) – Revision to add the occupation of Reinforcing Metal Worker. Related instruction to be provided in house by the JATC.
Mr. Vontran noted that the ratio would be one (1) apprentice to three (3) journeworkers in order to be consistent with their Collective Bargaining Agreement.
A motion to approve this revision was made by Ms. Butt, seconded by Mr. Clinedinst and unanimously approved.
8. Tree Care Industry Association (John F. Vontran) – Revision to the minimum qualifications for apprenticeship to permit the registration of high school students in an approved School-to- Apprenticeship program.
A motion to approve this revision was made by Ms. Butt, seconded by Mr. Bromley and unanimously approved.
C. PROGRAM REVIEWS (Five (5) or More Apprentices):
1. The Education Foundation of Baltimore County Public Schools (Lorella Dicks).
A motion to accept this review, with staff findings and recommendations, was made by Mr. Shmelzer, seconded by Mr. Clinedinst and unanimously approved.
2. Maryland Manufacturing Extension Partnership Inc. (Mark Millen).
A motion to accept this review, with staff findings and recommendations, was made by Mr. Shmelzer, seconded by Mr. Smarte and unanimously approved.
D. PROGRAM REVIEWS (Fewer Than Five (5) Apprentices):
1. The following program reviews had been performed and the programs were found to be conducted in a satisfactory manner. [No Council Action Required]:
a. Chesapeake Bay Maritime Museum, Inc. (Jane Sinclair) -
Occupation of Shipwright.
b. Cooper Electrical Services, Inc. (Kelton Addison) – Occupation of Electrician.
c. CVS Health (Ginamarie Best) – Occupations of Pharmacy Technician and Retail Store Manager.
E. OTHER BUSINESS:
1. Recommendation for deregistration of Apprenticeship Standards for the defunct apprenticeship program of Garray Machine Company, Inc. (MATC No. 1298) (Christopher D. MacLarion).
2. Recommendation for deregistration of Apprenticeship Standards for the defunct apprenticeship program of Poplar Machine Company, Inc. (MATC No. 1948) (Christopher D. MacLarion).
3. Recommendation for deregistration of Apprenticeship Standards for the defunct apprenticeship program of United Auto Center, Inc. (MATC No. 1662) (Christopher D. MacLarion).
A motion to consider the above recommendations as a group was made by Mr. Shmelzer, seconded by Mr. Bromley and unanimously approved.
A motion to preceed with the deregistration of Apprenticeship Standards for the defunct apprenticeship programs of Garray Machine Company, Inc., Poplar Machine Company, Inc and United Auto Center, Inc. was made by Mr. Smarte, seconded by Mr. Clinedinst and unanimously approved.
4. Associated Builders and Contractors, Inc., Baltimore Metropolitan Chapter (John F. Vontran) – Request to register an apprentice Plumber with credit for on-the-job training and related instruction beyond the fifty percent (50%) level due to delayed registration.
Employer Representative Michelle L. Butt recused herself from the consideration of this item of Council business.
A motion to approve this request was made by Mr. Smarte, seconded by Mr. Bromley and approved with six (6) members in favor of the motion, none opposed and one (1) abstenion.
5. Request for the approval of Land Cruiser Heaven, LLC to be an eligible employer for Apprenticeship Maryland (Youth) (Jennifer D. Runkles).
A motion to approve this request was made by Mr. Bromley, seconded by Ms. Butt and unanimously approved.
6. Request for the approval of the Washington County Museum of Fine Arts to be an eligible employer for Apprenticeship Maryland (Youth) (Jennifer D. Runkles).
A motion to approve this request was made by Mr. Cluster, seconded by Mr. Smarte and unanimously approved.
7. Request for the approval of Gross Mechanical Laboratories, Inc. to be an eligible employer for Apprenticeship Maryland (Youth) (Jeffrey W. Smith).
A motion to approve this request was made by Mr. Smarte, seconded by Mr. Clinedinst and unanimously approved.
8. Request for the approval of Minnick’s Inc. to be an eligible employer for Apprenticeship Maryland (Youth) (Jeffrey W. Smith).
A motion to approve this request was made by Mr. Shmelzer, seconded by Ms. Butt and unanimously approved.
9. Request for the approval of Wye River Marine, Inc. to be an eligible employer for Apprenticeship Maryland (Youth) (Jeffrey W. Smith).
A motion to approve this request was made by Mr. Smarte, seconded by Mr. Bromley and unanimously approved.
10. Baltimore City Joint Apprenticeship Committee (John F.Vontran) - Request for after-the-fact registration and completion of an apprentice Instrumentation Technician.
A motion to approve this request was made by Ms. Butt, seconded by Mr. Bromley and unanimously approved.
11. Requst for the approval of Burkholder’s Floor Covering to be an eligible employer for Apprenticeship Maryland (Youth) (Jennifer D. Runkles).
A motion to approve this request was made by Mr. Bromley, seconded by Mr. Smarte and unanimously approved.
Mr. MacLarion presented a recommendation that a regulations subcommittee be re-established to meet and review regulations coming from the local areas, state government and the federal government and how they impact apprenticeship. The subcommitee would consist of two Employer Representatives, two Employee Representatives and a Public Representative.
A motion to re-establish a regulations subcommittee was made by Mr. Bromley, seconded by Ms. Butt and unanimously approved. Membership on the regulations subcommittee would consist of Mr. Shmelzer, Mr. Smarte, Mr. Clinedinst, Mr. Wilford and Ms. Banovic.
Mr. MacLarion relayed to Council members one of the success stories from Maryland that had appeared in the monthly NASTAD-OA newsletter about an honors graduate of the International Union of Operators Local No. 99 Joint Apprenticeship Committee program as a Stationary Engineer. He encouraged the submission of such success stories.
Mr. Wallace announced that two days following the Apprenticeship Maryland Conference the 46th State Skills USA competitions would be taking place.
Mr. Leonard commented that the number of success stories from Maryland in the NASTAD-OA newsletter represented the commitment of apprenticeship stakeholders in Maryland.
There being no further business to come before the Council, the meeting of the Maryland Apprenticeship and Training Council was adjourned at 10:30 a.m.
